FACTS
'A' tried seducing a 14-year-old who is the prosecutrix, but the girl's father forbade such a relationship. 'A' started sending messages to the girl by 'J'. 'J' sent a message to the girl to come at his house at midnight to be taken to 'A'. After coming to 'J''s house she was taken to 'A'.

Is this kidnapping under Sec 137 of the Bhartiya Nyaya Sanhita?
JUDGEMENT
The Court held that the action of 'J' was the cause of the girl leaving the lawful guardianship of the father and come to him and his co-accused. Both the accused had the intention to take the girl out of lawful guardianship of her father and succeeded in it constituting the crime of Kidnapping.
