
FACTS
Two brothers got into a quarrel for one of them whistling at a place frequented by women. The quarrel escalated and one of them ran back home brought a weapon and stabbed the deceased to death. ISSUES
Whether the injuries are sufficient to cause death in the ordinary course.
JUDGEMENT
The evidence showed that the knife did not damage any vital organ and the deceased died due to infection. The court did not find any intention to cause death. There was found to be no intention to cause death, however, the injuries were intended which likely would have caused the murder. Therefore, he was found guilty of culpable homicide not amounting to murder.
