General Counsel at the state Comptroller advised against investing in FA Technology Venture. The General Counsel received an anonymous phone call, asking him to change his recommendation lest he wants his wife to know about his extra-marital affair. FBI traced the call to Giridhar Sekhar

ISSUE

Is the recommendation of a government employee subject to extortion?

JUDGEMENT

The court in unison held that compelling a person to change his recommendation on a subject does not amount to extortion. There is no delivery of property therefore no extortion could take place.
