FACTS

The son of the deceased inflicted injury to the leg leading to the amputation of the appellant in revenge for which the accused confronted the deceased. One person held him while the other struck him with a stick on his arms and legs and gave 18 injuries, as a result, the victim died.

ISSUE

Is the accused liable for Murder or Culpable Homicide not amounting to murder?

JUDGEMENT

The court observed that none of the injuries were to vital organs and the beatings were meant to be revenge for the previous injury inflicted on leg and not intended to cause murder. However, the injuries were known to be likely to cause death. Therefore the accused was imprisoned to life.
