CHIEF SETTLEMENT COMMISSIONER Vs OM PRAKASH || AIR 1969 SC 33 || Principles of Natural Justice

CHIEF SETTLEMENT COMMISSIONER vs OM PRAKASH, AIR 1969 SC 33

parliament

Facts of the Case

Om Prakash challenged an order issued by the Chief Settlement Commissioner under the relevant land revenue settlement legislation. The Commissioner had exercised his statutory power to determine and revise land records and revenue assessments in a particular area. Om Prakash contended that the settlement order was arbitrary, alleging that the Commissioner had not adhered to the required procedural safeguards or natural justice principles. The dispute was brought before the Supreme Court to determine whether the exercise of power by the Commissioner was legally justified.

Issues

1. Whether the Chief Settlement Commissioner exceeded his statutory authority in issuing the settlement order.

2. Whether the procedures followed in arriving at the settlement decision met the standards of natural justice.

3. Whether the settlement order was arbitrary and, if so, whether it should be set aside.

Judgment

The Supreme Court held that the Chief Settlement Commissioner acted within the bounds of his statutory powers. While acknowledging that the Commissioner possessed significant discretionary authority in matters of land settlement, the Court found that the procedures adopted did not breach the principles of natural justice. The decision was not arbitrary, and judicial review would be limited to instances of manifest error or abuse of power. Consequently, the settlement order was upheld.
