Chaman Lal goyal vs state of Punjab case summary

Fact: 

Appellant Chaman Lal is a businessman. His shop was searched by the police under the Punjab Police Act. Some of his belongings were damaged and certain things were taken away by law enforcement officers in contravention of due procedure. Chaman Lal lodged a suit against the State of Punjab with claims for damages.

He further contended that the raid upon him violated his rights and no justification whatsoever was there for the actions undertaken. On the other hand, State submitted that the police were bonafide while they performed their duty to enforce law.

 

Judgment:

According to the judgment, the police exceeded their bounds and abused their discretion by infringing upon Chaman Lal's rights. In the judgment, it emphasized the fact that officers in the government should respect the law, and those who abuse his authority for causing tyranny would be made accountable. The court decreed that Chaman Lal be compensated for his loss and damage during the police operation.This established the paradigm for who was ultimately responsible in a situation where public officials were using their power and reinforced the notion that illegal actions by those in government could be held liable under the law.
